1. About These Terms
These Terms & Conditions govern your use of fynixmedia.com and any services provided by Fynix Media Sdn Bhd ("Fynix Media", "we", "us"). By engaging our services or using our website, you agree to these terms.
2. Our Services
Fynix Media provides digital marketing services including but not limited to performance marketing, marketing automation, funnels and pipelines, AI agents, SEO, content creation, social media management, and reputation management. All services are delivered on a quote basis following an initial audit or consultation.
3. Payment Terms
- All services require full payment before work begins.
- We do not commence any work until payment has been received and confirmed.
- Invoices are issued prior to each service period.
- Accepted payment methods will be confirmed at the point of engagement.
4. Refund & Cancellation Policy
New Clients — Setup Fees:
Setup fees are non-refundable once work has commenced. This covers the time, resources, and strategy work invested from day one.
Ongoing Monthly Services:
Monthly services are cancellable with a minimum 30-day written notice sent to hello@fynixmedia.com. No refunds are issued for the current active month once the service period has begun.
Free Audit:
The free marketing audit is provided at no cost and carries no obligation to engage our services.
5. Client Responsibilities
To deliver results effectively, clients agree to:
- Provide accurate and complete information when requested.
- Grant necessary access to ad accounts, websites, and platforms in a timely manner.
- Respond to communications within a reasonable timeframe.
- Ensure all content provided to Fynix Media does not infringe on third-party rights.
6. Intellectual Property
All strategies, frameworks, and creative work produced by Fynix Media remain our intellectual property until full payment has been received. Upon full payment, ownership of deliverables transfers to the client unless otherwise agreed in writing.
7. Confidentiality
Both parties agree to keep confidential any sensitive business information shared during the engagement. This obligation continues after the engagement ends.
8. Limitation of Liability
Fynix Media provides services based on best practices and available data. We do not guarantee specific results as marketing outcomes are subject to market conditions, platform changes, and client-side factors outside our control. Our total liability in any circumstance shall not exceed the total fees paid by the client in the preceding 30 days.
9. Governing Law
These terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
10. Changes to These Terms
We reserve the right to update these terms at any time. Continued use of our services following any changes constitutes acceptance of the updated terms.
